EJCDC® Contract Documents

The Engineers Joint Contract Documents Committee® (EJCDC®) develops and updates fair and objective standard documents that represent the latest and best thinking in contractual relations between all parties involved in engineering design and construction projects. The committee is made up of the National Society of Professional Engineers, the American Council of Engineering Companies, and the American Society of Civil Engineers and involves the participation of more than 15 other professional engineering design, construction, owner, legal, and risk management organizations.

EJCDC documents are available to members of the National Society of Professional Engineers at a 50% discount.

Public Private Partnership ("P3") Agreement

EJCDC® P3-508 Public Private Partnership ("P3") is for use by government entities to finance, construct, maintain and provide public improvements and services. P3-508 is a resource for use in jurisdictions that allow for the procurement of improvements and services through P3 relationships. P3-508 was developed with the flexibility to allow the user to select specific construction, financing, O&M and funding terms to be used in finalizing the P3-508 form agreement. The agreement also provides flexibility to allow for differences in statutes, regulations, financing requirements, and to cover various forms of services or improvements.

Rural Utilities Service's EJCDC® Policy

It is the Rural Utilities Service's policy that the Engineers Joint Contract Documents Committee® (EJCDC®) documents be used as the foundation for the engineering and construction contract documents for all Water and Waste Disposal program actions. The EJCDC® has developed the following documents which will be considered previously approved by the Agency for use by applicants, owners, and borrowers in the Rural Utilities Service's Water and Waste Disposal program.

When these documents are properly coordinated with other documents in the EJCDC® set of Construction Related Documents, the documents are acceptable for use by RUS applicants and borrowers in the procurement of engineering professional services and utility construction services for projects with financial assistance under the Water and Waste Disposal programs.

Bulletin 1780-26 pre-approves the use of a selection of the 2018 edition of the C Series documents and the use of select 2014 editions E-500. It was updated on 5/24/23 to incorporate The Build America, Buy America Act (BABAA) provisions of the Infrastructure Investment and Jobs Act (Pub. L. 117-58, § 70901-52).
