On June 20, 2016, NSPE filed a “friend of the court” brief in the Maryland Supreme Court supporting the economic loss doctrine, which protects design professionals against limitless claims by contractors with whom they do not have a direct contractual agreement.

Most recently, in the case of Balfour Beatty Infrastructure Inc. vs. Rummel Klepper & Kahl LLP, NSPE has asked the Maryland Supreme Court to affirm a lower court decision recognizing the predictability and certainty in the allocation of risk in the construction industry. A reversal of this decision by the Maryland Supreme Court would not only harm design professionals, but also would increase the costs of public and private procurement. In its legal brief, the Society argues that if the court reverses the lower court decision, the scope of liability for design professionals would greatly expand. Such an outcome would undermine the ability of design professionals to enter into contracts that appropriately allocate commercial risks and responsibilities that reflect the commercial risks inherent in the design and construction process.

The case of Balfour Beatty Infrastructure Inc. vs. Rummel Klepper & Kahl LLP is a prime example of the importance and value of the NSPE Legal Fund and its impact on the engineering profession.
